ORDER OF CIRCUIT COURT
ANDERSON, Judge.
For the reasons stated in the accompanying Memorandum, petitioner’s application for a writ of habeas corpus is denied.
ANDERSON, Judge, dissenting:
I dissent.
The majority acknowledges that the notice requirements of § 8-10-101, Ala.Code 1975, were not met. However, it holds, without an evidentiary hearing, that petitioner’s claim of ineffectiveness of counsel was without merit. My review of the record convinces me that petitioner did not receive his constitutional right to effective assistance of counsel.
Petitioner is procedurally barred from proceeding on the basis of this contention. A.R.Crim.P., Rule 32.2(a), states:
«This Rule shall not be employed to raise or to review any ground for relief which was raised or considered on appeal or in any previous collateral proceeding. A previous finding of facts made in the proceedings shall be presumed to be correct by the court. An evidentiary hearing shall not be granted unless the petition alleges facts which, if true, would entitle the petitioner to relief.»
A.R.A.P., Rule 32.7(d), bars review of a claim of ineffectiveness of counsel on appeal unless the ineffectiveness claim was presented to the trial court as a ground for relief either in the motion for a new trial or in a Rule 32 petition. That ground being the basis of this petition, petitioner is procedurally barred on this claim, just as he is procedurally barred on the contention that the trial court failed to hear his petition.
The Supreme Court in Ex parte Grayson, 479 So.2d 76 (Ala.), cert. den., 474 U.S. 865, 106 S.Ct. 189, 88 L.Ed.2d 157 (1985), stated:
